City of Oakland ADU Permits in 2026: Building Criteria Checklist, Rules & Timelines

Oakland is a strong ADU market — no owner-occupancy rule for standard units, parking waived near transit, and pre-approved plan sets that speed up review. But Oakland also has a few local requirements other cities don't, most notably an all-electric mandate for new detached ADUs. All-electric, meters & utilities

This is where Oakland differs most from neighboring cities. Per the City's checklist:

  • New detached ADUs must be all-electric (OMC 15.37) — no gas appliances allowed.
  • ADUs require a separate electrical meter (per CPUC 780.5); JADUs do not.
  • A detached ADU shouldn't need a separate PG&E electrical drop and should have access to its own electrical panel.
  • Each unit needs permanently installed heating and water heating with its own controls; heating/AC/ventilation can't combine return air between units.
  • A detached ADU needs its own water shutoff valve; the ADU's sewer-lateral branch connection can't run underneath the primary residence.
  • ADUs get separate addresses; JADUs do not.

The One-Family ADU Building Criteria Checklist

Oakland requires you to certify that your project meets each item on its ADU Building Criteria Checklist (you must answer "Yes" or "N/A" to every line). The key building-code criteria:

  • Independent egress: the ADU and primary residence each have their own entry/exit to the public right of way; the ADU's path of egress can't run through another dwelling.
  • Moisture & structure: meets requirements for damp-proofing, waterproofing, vapor retarder, braced wall panels/shear walls, and all energy-code requirements.
  • Dug-down/basement levels: meet new-construction requirements with engineered foundation and lateral-load plans.
  • Separate heating: each unit has independent access to its own mechanical heating and water heater (a shared mechanical room is allowed only with independent access).
  • Fire separation distance: the ADU is entirely within the property and meets building fire-separation requirements (may require surveyor certification).
  • Sound (attached ADUs): minimum STC 50 / 50-45 sound-transmission rating.
Watch the 50% rule: demolishing more than 50% of an existing building makes it a new building (not a conversion) for code purposes, per Code Bulletin D-18-001 — which can change the requirements that apply. If field conditions force removal past 50% during construction, you must submit a revision first.

Fire separation & safety

Oakland's checklist sets specific fire requirements that often drive design:

  • Exterior walls are fire-rated based on fire-separation distance and construction type; no wall openings within 5 ft of a property line (3 ft if sprinklered).
  • Fire sprinklers are required in the entire building when the combined floor area (ADU + primary) exceeds 3,600 sq ft, or when the primary residence is required to have sprinklers.
  • For a new or substantially rehabilitated primary residence, the nearest hydrant must flow more than 1,000 gpm at 20 psi.

Owner-occupancy & JADUs

Owner-occupancy is not required for a standard ADU in Oakland. A JADU (up to 500 sq ft within the primary dwelling) does require the owner to live in either the JADU or the primary unit. JADUs are simpler in several ways: they don't get a separate address, don't need separate electrical or gas meters or fire separation from the primary dwelling, and aren't subject to the STC-45 sound requirement.
